Common questions
What is the 183-day rule in Spain?
If you spend >183 days in Spain in a calendar year, you're considered tax resident. This is the primary test; others exist.
Can I avoid tax residency in Spain?
Only if you stay ≤183 days AND have no economic centre in Spain (work, business, family). This is hard to sustain.
What if I become tax resident mid-year?
You must pay Spanish taxes from the day you become resident. You're not exempt for the first few months.
Does a tourist visa avoid residency?
No. Tax residency is automatic if you meet the criteria, regardless of visa type.
How do I prove I'm tax resident?
Obtain a TIE (Tarjeta de Identidad de Extranjero) or EU registration certificate. Register with Hacienda (tax authority).
